On June 21, Governor Greg Abbott signed House Bill 46, expanding Texas’ medical cannabis program. This bill went into effect on September 1, 2025, marking a major step toward improving access to medical cannabis through the Texas Compassionate Use Program (TCUP). Medical Cannabis Vaporization Legal in Texas

Medical cannabis vaporization products are legal for patients under the Compassionate Use Program. To purchase a medical cannabis vaporization device from Texas Original, you must be a registered TCUP patient and your prescription must specifically allow pulmonary inhalation as a method of administration.

Improved Regional Access to Medical Cannabis

Licensed medical cannabis dispensaries in Texas are now allowed to store products at satellite locations approved by the Department of Public Safety (DPS). This change improves medical cannabis access in rural areas, reduces wait times to fill a prescription and assists Texans with limited mobility or access to transportation. This change may allow dispensaries to lower distribution costs and medication costs for patients.

There are more than 18 pickup locations across Texas where patients can receive their medical cannabis from a licensed dispensary. In areas without a pickup location, patients can receive a home delivery.

THC Laws in Texas

THC laws in Texas were changed under House Bill 46. The 1% THC cap was replaced with a milligram cap of 10 mg per dose. Additionally, medical cannabis products may have up to 1,000 mg per package. By utilizing milligrams to measure THC, the amount of filler ingredients in products can be reduced, allowing for more product options, like medical vaporization devices and more concentrated options.
